At Moreno Valley Unified School District, we believe every student has the right to a safe, healthy, and respectful school environment. We are committed to fostering a culture of mutual respect, tolerance, and acceptance. Any behavior that infringes on the rights or safety of students, whether by other students or adults, will not be tolerated.

Our Bullying Policy applies to all forms of misconduct, including student-to-student and adult-to-student interactions (BP and AR 5131.2, BP 4030).

Bullying, harassment, or intimidation based on actual or perceived personal characteristics is strictly prohibited. These include, but are not limited to, sex, sexual orientation, gender, gender identity or expression, race or ethnicity, religion, color, mental or physical disability, nationality, age, immigration status, or association with any person or group identified by these characteristics.

We recognize that national or state-level events may bring uncertainty or concern into our school community. In response, we reaffirm our unwavering commitment to maintaining a welcoming and inclusive environment for every student, family, and staff member.

The Moreno Valley Unified School District’s Title IX Office is dedicated to ensuring all students and staff learn and work in an environment free from sex discrimination, sex-based harassment, and sexual misconduct. We take all reports seriously and respond in accordance with federal law and District policies.

Title IX protects individuals from:

• Sex Discrimination – Unequal treatment in employment, education programs, or activities based on a person’s actual or perceived sex, sexual orientation, gender identity, pregnancy status, sex stereotypes, or related characteristics.
• Sex-Based Harassment – Unwelcome behavior of a sexual nature, including sexual violence, that creates a hostile environment and interferes with someone’s ability to participate in school or work activities.

Reporting Responsibilities
Even if certain behavior doesn’t meet the legal definition under Title IX, all employees are required to report any form of sexual harassment to the District’s Title IX Office under Administrative Regulation 5145.7. Any allegation involving misconduct will be thoroughly reviewed and addressed through the appropriate District process.

If an incident occurs, Moreno Valley Unified School District prioritizes the safety and well-being of all students and staff. The District will take immediate steps to implement safety plans and supportive measures as needed.

To report any concerns or threats to student or staff safety, please use our MVUSD Concern Reporting system. The District’s Safety and Security Office will promptly review your report and take appropriate action to ensure a safe and secure school environment.

Student-to-student misconduct is governed by the District’s Restorative Progressive Discipline Matrix (RPDM). The (RPDM) provides a detailed outline of how the District responds and addresses various forms of misconduct in these policies and procedures.

To report concerns, you can submit the report via our MVUSD Concern Reporting system or MVUSD's CARE Portal. 

Moreno Valley Unified School District is committed to upholding the highest standards of professionalism among all staff, and we take all allegations involving employees seriously. Any reports concerning employee conduct are carefully reviewed and addressed through the appropriate District policies and procedures, with follow-up conducted by our Human Resources Department to ensure fairness and accountability.

We encourage all staff, students, and families to familiarize themselves with our Professional Adult/Student Boundary Policy (BP 4019.1). This policy is designed to foster safe, respectful, and appropriate relationships between employees and students, reinforcing a positive and healthy learning environment across our schools.

If a concern arises, individuals are encouraged to submit a report confidentially through the MVUSD Concern Reporting system. Every report received is reviewed with care and handled in a manner that prioritizes student safety and promotes trust in the process. 

Should you wish to move forward with formally filing a complaint against an employee after first addressing the matter at the site level, you may complete the District Employee Complaint Form or utilize the MVUSD Concern Reporting system. The form should be downloaded, completed to the best of your ability, and delivered to the Human Resources Department at the Romelio Ruiz Community Education Center (District Office), located at 25634 Alessandro Boulevard, Moreno Valley, CA 92553. Please note that complaints must be filed with the immediate supervisor or administrator of the employee within 30 calendar days of the date the complainant knew of the events giving rise to the concern.

If you are a Moreno Valley Unified School District employee, you may report concerns confidentially through our MVUSD Concern Reporting system. All reports are reviewed carefully and addressed in accordance with applicable District policies and procedures.

Our Resolution Officer collaborates closely with the Human Resources Department to ensure timely and thorough follow-up on all employee-related reports.

All reports submitted through our MVUSD Concern Reporting system are carefully reviewed to ensure that each concern is promptly addressed and directed to the appropriate District administrator or department for follow-up. If you are uncertain about how to categorize your concern or which reporting path to take, we encourage you to use the MVUSD Concern Reporting system. Our team will ensure your report is routed correctly and managed in accordance with District policies and procedures.

If your concern involves alleged violations of federal laws or regulations that prohibit unlawful discrimination, harassment, intimidation, and/or bullying, you may also consider filing a Uniform Complaint. These protections apply to concerns based on actual or perceived sex, race or ethnicity, color, national origin, nationality, religion, age, sexual orientation, ancestry, gender, gender identity, gender expression, disability, or a person’s association with an individual or group with one or more of these characteristics. Uniform Complaints may also be filed regarding certain academic programs, pupil fees, or issues related to the Local Control and Accountability Plan (LCAP).

Williams Complaint: Deficiencies related to instructional materials, conditions of facilities that are not maintained in a clean or safe manner or in good repair, and teacher vacancy or misassignment.

A formal Title IX complaint can be filed by:

• A current student or former student who experienced sex discrimination or sex-based harassment while participating or attempting to participate in a District education program or activity.
• A parent/guardian or other authorized legal representative who has the legal right to act on behalf of a student.
• A District employee or former employee who personally experienced sex discrimination or sex-based harassment in the workplace or within a District program or activity.

In certain circumstances, if the individual directly affected does not wish to file a formal complaint, the Title IX Coordinator may determine that an investigation must proceed in order to ensure the safety of the school community.

No. Formal complaints under Title IX cannot be filed anonymously due to federal regulations requiring that both parties receive notice of the allegations, including the identities of those involved.

However, if you wish to remain anonymous but still want to alert the District to a concern, you may file a confidential report, which allows you to remain unidentified. Please note that while we will follow up on anonymous reports to the extent possible, some actions (including formal investigations) may be limited by the lack of identifying information.

Employees play a key role in ensuring student safety and must report observed or known incidents of sex-based harassment or discrimination.

Under Administrative Regulation 5145.7, employees are required to report any incident involving sex discrimination or sex-based harassment by or against a student within one workday to the Title IX Coordinator, regardless of whether the student wishes to file a formal complaint.

This is not the same as filing a formal complaint. Only the affected individual (or a guardian/legal representative) may decide whether to formally initiate the grievance process.

When speaking with students or parents, you may say:

“I’m required to report this to the District’s Title IX Office so they are aware and can offer support. They may follow up with you directly to provide options and resources.”

Title IX specifically prohibits:

• Sex discrimination, including unfair treatment or denial of opportunities based on sex, sexual orientation, gender identity, sex stereotypes, or pregnancy-related conditions;
• Sex-based harassment, which includes quid pro quo harassment by staff or authorized individuals;
• Hostile environment harassment, including unwelcome conduct that is severe or pervasive; and
• Sexual assault, dating violence, domestic violence, and stalking, as defined under federal law.

Not all misconduct qualifies as a Title IX violation, but that does not mean it will be ignored. Any form of behavior that violates District policies will be thoroughly reviewed and may result in appropriate student discipline, employee corrective action, or other administrative responses.

Complaints pertaining to Title IX issues should be filed utilizing the procedures detailed below as found at the U.S. Department of Education's Office of Civil Rights. 

"If you believe you have been discriminated or retaliated against on any of these bases by a covered entity, you may file a complaint using either the electronic complaint form or the fillable PDF complaint form linked at the bottom of this page.  

If you choose to file a complaint using either method, you will be asked to provide your name, address, and email address; the name and address of the person discriminated against; and the name and address of the entity you believe discriminated.  
You also will be asked which of the kinds of discrimination forms the basis for your complaint. You will need to provide a description of the conduct that you believe is discriminatory.  

By law, complaints of discrimination must ordinarily be filed within 180 days of the last act of discrimination. If your complaint involves matters that occurred longer ago than this and you are requesting a waiver, you will be asked to show good cause why you did not file your complaint within the 180-day period. 
You will be asked whether you have tried to resolve the matter using a grievance procedure or by filing with another agency. 

In addition to the complaint, a signed Consent Form may be required. When disclosure of the identity of the complainant is necessary in order to resolve the complaint, OCR will require written consent before proceeding. The complainant will be informed that the complaint will be closed if written consent is necessary in order to resolve the complaint and is not received within 20 calendar days of the date of the acknowledgement letter or the date the Consent Form is requested from the complainant. The signed Consent Form may be submitted to OCR by mail, fax, email (with a scanned attachment), or in person.  

When OCR has determined that consent is necessary in order to resolve the complaint and OCR has not received a signed Consent Form by the 15th calendar day of the date of the acknowledgment letter or the date the Consent Form is requested from the complainant, OCR will contact the complainant (e.g., by phone) to inform the complainant that the complaint will be closed if the signed Consent Form is not received within 5 calendar days. If OCR does not receive signed written Consent Form, the complaint will be dismissed, and the complainant informed in writing.  

A complainant on behalf of or regarding to another person(s) is responsible for securing any necessary written consent from that individual, including when a parent files for a student over the age of 18. Where the person is a minor (under the age of 18) or a legally incompetent adult, the Consent Form must be signed by that person’s parent or legal guardian. Parental or legal guardian consent may not be required for persons under the age of 18 if they are emancipated under state law and are therefore considered to have obtained majority. Proof of emancipation or incompetence must be provided.   

If you submit the completed electronic complaint form, it will be routed to the OCR office with authority to handle complaints in the state where the institution or entity you are complaining about is located. A staff person will contact you once your electronic complaint has been received and reviewed.  

If you select the fillable PDF complaint form, once you complete the complaint form and Consent Form, you should print them out, sign them; and mail them (or email scanned copies of the signed forms) to the Enforcement Office with authority for the state where the institution or entity you are complaining about is located. Once a formal complaint is submitted, the following steps take place:

Initial Review by the Title IX Coordinator
The complaint is reviewed to determine if the allegations, if proven true, would meet the legal definition of Title IX sex discrimination or sex-based harassment.

Determination of Jurisdiction
If the alleged conduct falls within Title IX jurisdiction, the complaint will proceed through the Title IX grievance process (outlined in AR 5145.71).

If not, the Title IX complaint will be dismissed, and the matter may be addressed under another District policy (e.g., the Uniform Complaint Procedures or the Employee Complaint Process).

Notification to Parties
Both the complainant and respondent will receive written notice of the allegations and an overview of the investigation process.

Assignment of Investigator
A trained, certified Title IX Investigator from the ICA team will be assigned to conduct the investigation.

What Can Immediately Be Done to Ensure My Safety and Well-Being?
The Title IX Coordinator or designee will offer supportive measures regardless of whether a formal complaint is filed. These are non-disciplinary and non-punitive services designed to:

• Ensure continued access to education
• Protect the safety of all individuals involved
• Prevent retaliation or further misconduct
• Examples include:
• Adjusted class schedules
• Campus escort services
• Temporary no-contact directives
• Counseling or mental health referrals
• Academic support

Supportive measures remain in place as long as needed and can be modified based on the evolving needs of the complainant and respondent.

Informal Resolutions
At any point before a final decision is issued, the District may offer an informal resolution process, if both parties agree and the Title IX Coordinator determines it is appropriate.

This is a voluntary process and may include mediation, restorative conferencing, or other agreed-upon solutions.

An informal resolution cannot be offered if:

• The complaint involves an employee and a student, or
• The conduct presents a significant safety risk or ongoing harm

Investigation Procedures
Upon the determination that the formal complaint, if proven, would constitute a violation of Title IX, the following steps will occur:

When a formal investigation is initiated, both parties receive written notification that includes:

• The identity of the involved parties- The regulations require the disclosure of the identity of the parties involved. We understand that complainants may not want to be identified due to fear of retaliation or continued harassment. If you have questions or concerns, you can speak with the Title IX Officer prior to the
• Notice of Allegations. Our team is trauma-informed and understands sensitive nature of these incidents. Do not hesitate to reach out and we can provide support and guidance even if a formal investigation does not occur.
• A summary of the alleged conduct
• The applicable policies and potential consequences

If you're unsure about disclosing your identity, you may speak confidentially with the Title IX Office before filing. The District uses a trauma-informed approach to support your safety and comfort.

The assigned investigator will:

• Interview witnesses
• Gather documentation
• Both parties will have an equal opportunity to present evidence on their behalf. Both parties will also have an opportunity to review the relevant evidence gathered at the conclusion of the investigation and both parties will have an opportunity to respond to the evidence.

At the conclusion, both parties may review the evidence and submit a written response.

Written Determination
A neutral decisionmaker evaluates all evidence and determines whether a policy violation occurred using the preponderance of evidence standard.

A detailed written decision is sent to both parties, outlining the findings and rationale.

Appeals Process
Either party has the right to appeal the outcome based on:

• Procedural error
• New evidence
• Conflict of interest or bias

The full process may take up to 90 calendar days, although extensions may be granted for good cause (e.g., school breaks, complexity of the case).
